The Holiday Let Agreement is specifically excluded from the Housing Act 1988, so tenants have no security of tenure and must vacate the property at the end of the fixed term, or if found to be in breach of the terms of the Holiday Let Agreement. The Holiday Agreement can be for any length of time, as long as it is for a genuine holiday let.
This agreement is intended for use only for a Holiday Let. If the circumstances make it clear that the letting is NOT for the purposes of the Tenant’s holiday, for example because the Term is so long, the Courts may hold that it is an Assured Shorthold Tenancy (and you will not be able to obtain an order for possession of the Property for at least six months from the beginning of the tenancy).
