Lawpack.co.uk Terms & ConditionsPlease read this document carefully as it affects your rights and liabilities under the law and sets out the terms under which Lawpack Publishing Limited (Lawpack) provides any products or services made available through Lawpack.co.uk. 1. Use of Lawpack.co.uk Lawpack.co.uk is operated and maintained by Lawpack. Unless otherwise stated, all products and services made available through the Lawpack.co.uk are provided by Lawpack. Registration is not required, but by placing an order you agree to be bound by these Terms and Conditions. Specific services made available through Lawpack.co.uk (such as the will storage service) may be subject to additional terms and conditions, which will apply concurrently to these Terms and Conditions. 2. Amendments Lawpack may update these Terms and Conditions from time to time and any changes will be notified to you via the e-mail address provided by you when you placed your order or via a suitable announcement on Lawpack.co.uk. The changes will apply to the use of Lawpack.co.uk after Lawpack has given notice. If you do not wish to accept the new Terms and Conditions you should not continue to use Lawpack.co.uk. If you continue to use Lawpack.co.uk after the date on which the change comes into effect, your use of Lawpack.co.uk indicates your agreement to be bound by the new Terms and Conditions. 3. Prices The prices and delivery charges payable for the products or services that you order are clearly set out on Lawpack.co.uk. If, by mistake, an item is under-priced, Lawpack will not be liable to supply that item to you at the stated price, provided that Lawpack notifies you before the item is dispatched. All prices are expressed inclusive of any VAT payable unless otherwise stated. 4. Acceptance There will be no contract of any kind between you and Lawpack unless and until Lawpack actually dispatches the goods to you. Your order is an offer to buy from Lawpack. Nothing that Lawpack does or says will amount to any acceptance of that offer until Lawpack dispatches the goods to you. At any point up until then, Lawpack may decline to supply the goods to you without giving any reason. At the moment that the goods are dispatched (and not before), a contract will be made between you and Lawpack, and you will be charged for the goods. 5. Delivery Delivery will be made to the address specified by you on the completed order form. Please note that Lawpack can only deliver products within the UK. Lawpack will aim to deliver goods as stated but cannot guarantee delivery by such a date. 6. Cancellation If you order goods, you have the right to cancel your order up to 7 working days after the day following the placement of the order. In the event that the goods have already been dispatched at the date of receipt of your cancellation of the order you must return the goods and Lawpack will credit your credit or debit card with the price of the goods within 30 days beginning with the day on which notice of cancellation was given. Orders for electronic items (form downloads, e-kits) that have been downloaded may not be cancelled. If you do not return the goods within 21 days of your cancellation, Lawpack will make a charge in respect of the cost of recovering the goods. If you do not return the goods or fail to make them available for collection within 30 days of your notice of cancellation, you will be deemed to have accepted the goods, at which point a new purchase contract will be made and you will be charged for your order at the price set out on Lawpack.co.uk. If your order is for the provision of services, please note that you will be unable to cancel the contract once performance of the services has begun. This does not affect your statutory rights. 7. Returns You can return any purchase for non-electronic goods (books, kits or paper forms) within 30 days of the date the goods are received for any reason, on the sole condition that any item is returned to Lawpack in its original condition. Lawpack will issue a full refund for the price that was paid for the item. You have the right to return a faulty item within a reasonable period of time, but please keep any warranty information that accompanies the item as this will be needed should there be a fault. If you take delivery of a purchase from Lawpack and the contents have been damaged in transit, you may return the item(s) to Lawpack within 30 days of receipt for an exchange. If you return an item because of an error on Lawpack’s part or because it is defective, Lawpack will be happy to refund the delivery charges incurred in sending the item to you and the costs of returning it to Lawpack. If cancelling the purchase under the statutory 7 working days cooling-off period, Lawpack will refund the normal postage charge for the delivery of that item but cannot refund any express or courier postage charge. You will be responsible for those charges and the costs of any other services provided in connection with your purchase. 8. Intellectual property The content of Lawpack.co.uk is protected by copyright, trade marks, database and other intellectual property rights. You may retrieve and display the content of Lawpack.co.uk on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on Lawpack.co.uk. No licence is granted to you in these Terms and Conditions to use any trade mark of Lawpack or their affiliated companies including, without limitation, the trade mark LAWPACK. 9. Availability of Lawpack.co.uk Although Lawpack aims to offer you the best service possible, Lawpack makes no promise that Lawpack.co.uk will be fault free and available at all times. If a fault occurs in the service you should report it to Customer Services (see below for contact details) and Lawpack will attempt to correct the fault as soon as reasonably possible. Your access to Lawpack.co.uk may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. Lawpack will attempt to restore the service as soon as it reasonably can. 10. Liability Due to the standardised nature of the products and services made available through Lawpack.co.uk, Lawpack cannot guarantee that such products and services will meet your precise needs or circumstances. You must also bear the risks associated with the use of the Internet. If you are in doubt as to the suitability of the products or services made available through Lawpack.co.uk to your circumstances, Lawpack strongly recommends that you seek advice from a qualified solicitor before using such products or services. Please note that any standard products and services made available through Lawpack.co.uk are not intended to be a substitute for tailored legal advice and that there may be special factors that should be taken into account in particular cases. You agree that Lawpack will not be liable to you or any third party for any consequential or incidental loss or damage (including but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other direct, indirect, special or punitive damages whatsoever that arise out of or are related to the use of Lawpack.co.uk. Nothing in these Terms and Conditions shall exclude Lawpack’s liability for personal injury or death caused by its negligent act or omission or wilful misconduct or any other liability which cannot by law be excluded or restricted. 11. Data protection All personal information collected via Lawpack.co.uk will be used in accordance with the Privacy Policy. 12. Law and jurisdiction These Terms and Conditions will be governed by and construed in accordance with the laws of England and any disputes will be decided only by the English courts. 13. General You may not assign, sub-license or otherwise transfer any of your rights under these Terms and Conditions. If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect. If you breach these Terms and Conditions and Lawpack ignores this, Lawpack will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the Terms and Conditions.Lawpack shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its control. A person who is not a party to these Terms and Conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions but this will not affect any right or remedy of a third party which exists or is available apart from that Act. 14.
