Changes to the tax law for same-sex couples

As of 6 December 2005, same-sex couples have been able to register their relationship. From this date, all the tax legislation that applies to married couples also applies to them.

For instance, they are able to transfer assets to each other without incurring any Capital Gains Tax. However, if they have two main residences, they can only have one principal private residence exemption, so they may wish to consider making an election to nominate the main residence.

They are also be able to transfer assets to each other free of Inheritance Tax.
