New tenancy agreements in Scotland from 1 December 2017

From 1 December 2017, Short Assured Tenancies can no longer be created in Scotland; they are being replaced by Private Residential Tenancy agreements. The last day a  Short Assured Tenancy Agreement can be used to create a tenancy is 30 November 2017. Form AT6 cannot be used with Private Residential Tenancy agreements.

When to serve the AT6 form

This Form AT6 download (rent arrears claim) can be used by a landlord wanting to give notice to terminate a Short Assured Tenancy (SAT) in Scotland (under the Housing (Scotland) Act 1988).

This template includes two notices in it: the AT6 Notice and a Notice to Quit. Both these notices should be used when serving the tenant.

Landlords can use the notice to terminate for rent arrears in two ways. You can use the AT6 Notice to terminate and Notice to Quit when the tenant is in rent arrears of at least three months and, as long as you serve the Notice to Terminate properly, the court is guaranteed to grant you an order for possession of your property.

The AT6 Notice to Terminate and Notice to Quit can also be used if your tenant is in rent arrears of less than three months, but, in this instance, there is not a definite guarantee that the court will grant you an eviction order.

When completing this notice, a landlord should include a Schedule of Rent Arrears, which shows a landlord how to calculate the rent arrears figure that has to be included in this notice to terminate.

When this Form AT6 download can be used

This Form AT6 template can be used by a landlord to give notice to terminate a Short Assured Tenancy (SAT) for rent arrears in Scotland, under the Housing (Scotland) Act 1988. 

The AT6 form can be used to give notice to terminate a tenancy agreement made using the following Lawpack tenancy agreements:

  • Tenancy Agreement - Furnished (Scotland)
  • Tenancy Agreement - Unfurnished (Scotland)
  • Tenancy Agreement for a Room (Scotland)

This Notice to Terminate can not be used to terminate an Assured Shorthold Tenancy Agreement (in England & Wales) or a Lodger Agreement.

If you want to end a Short Assured Tenancy (SAT) in Scotland before the end of the fixed term, then you should use Lawpack's Section 33 Notice and Notice to Quit.
