Changes to divorce forms as of 6 April 2012

As of 6 April 2012 amendments have been made to a number of family divorce forms. Find out more on the latest changes...

The main amended divorce forms are listed below. These affect Lawpack's DIY Separation & Divorce Kit, which will be updated from 6 April with the relevent forms:

  • D8 - Divorce/dissolution/(judicial) separation petition
  • D80A - Statement in support of divorce/(judicial) separation – Adultery
  • D80B - Statement in support of divorce/dissolution (judicial) separation – Unreasonable behaviour
  • D80C - Statement in support of divorce/dissolution (judicial) separation – Desertion
  • D80D - Statement in support of divorce/dissolution (judicial) separation – Two-year separation
  • D80E - Statement in support of divorce/dissolution (judicial) separation – Five-year separation
  • D84 - Application for a decree nisi/conditional order or (judicial) separation decree/order [NB new name]
  • D81 - Statement of Information for a Consent Order
  • Form E - Financial statement
    • For a financial order under the Matrimonial Causes Act 1973/ Civil Partnership Act 2004
    • For financial relief after an overseas divorce etc under Part 3 of the Matrimonial and Family Proceedings Act 1984/ Schedule 7 to the Civil Partnership Act 2004

Note that divorce form D80AE will no longer be called ‘affidavit’, but instead 'statement'.

Other divorce forms that have changed include:

  • C100 - Application under the Children Act 1989 for a residence, contact, prohibited steps, specific issue section 8 order or to vary or discharge a section 8 order
  • D8B - Answer to a divorce/dissolution/(judicial) separation or nullity petition
  • D8D - Petition for a presumption of death decree/order and the dissolution of a marriage/civil partnership
  • D8N - Nullity Petition
  • D13B - Statement in support of a request to dispense with service of the divorce / dissolution / nullity /(judicial) separation petition on the Respondent
  • D20 - Medical examination: statement of parties and examiner
  • D50 - Notice of application under section 17 of the Married Women’s Property Act 1882/ section 66 of the Civil Partnership Act 2004
  • D50A - Notice of proceedings and acknowledgement of service under section 17 of the Married Women’s Property Act 1882/ section 66 of the Civil Partnership Act 2004
  • D50B - Application under section 17 of the Married Women’s Property Act 1882/ section 66 of the Civil Partnership Act 2004/ Application to transfer a tenancy under the Family Law Act 1996
  • D50C - Application on ground of failure to provide reasonable maintenance
  • D50D - Application for alteration of maintenance agreement after the death of one of the parties, under section 36 of the Matrimonial Causes Act 1973/ paragraph 73 of Schedule 5 to the Civil Partnership Act 2004
  • D50G - Application to prevent transaction intended to defeat prospective applications for financial relief
  • D80F - Statement in support of annulment – void marriage/civil partnership
  • D80G - Statement in support of annulment – voidable marriage/civil partnership
  • Form E Notes - Notes to Financial statement for a financial order or for financial relief after an overseas divorce or dissolution etc
  • Form E1 - Financial Statement for a financial remedy (other than a financial order or financial relief after an overseas divorce or dissolution etc) in the county or High Court
  • Form E2 - Financial Statement for a financial remedy in the magistrates’ court
  • Form P1 - Pension Sharing Annex under [section 24B of the Matrimonial Causes Act 1973] [paragraph 15 of Schedule 5 to the Civil Partnership Act 2004]

Why the change to the forms

The changes to the forms have been made by the Family Policy Division of the Ministry of Justice due to the Family Procedure (Amendment) Rules 2012 and also due to suggestions to improve the contents of the forms.

When to use the new forms

The amended forms should be used on and after 6 April 2012, but the amended forms must not be filed at courts before 6 April 2012.
