From 1 December 2017, Short Assured Tenancies can no longer be created; they have been replaced by Private Residential Tenancy agreements, and this Section 33 Notice and Notice to Quit cannot be used with Private Residential Tenancy agreements.

When to serve the section 33 notice form

This section 33 notice template can only be used by a landlord wanting to give notice to terminate a tenancy at the end of a Short Assured Tenancy (SAT) in Scotland, under the Housing (Scotland) Act 1988, and not a Private Residential Tenancy. 

To legally give notice to terminate a Short Assured Tenancy Agreement in Scotland at the end of the tenancy agreement the landlord must give a Section 33 Notice form and Notice to Quit to their tenant. 

Under the Housing (Scotland) Act 1988, the landlord must give the tenant at least two months' notice.

When this section 33 notice template can be used

This section 33 notice template can be used by a landlord to give notice to terminate a Short Assured Tenancy (SAT) in Scotland, under the Housing (Scotland) Act 1988. 

When this section 33 notice form cannot be used

This Section 33 Notice and Notice to Quit form cannot be used to give notice to terminate a tenancy agreement made using the following Lawpack Private Residential Tenancy agreements:

Please also be aware that this Section 33 Notice and Notice to Quit download cannot be used to give notice to terminate a Lodger Agreement - use Lawpack's Notice to Terminate a Lodger Agreement.

If your tenant on a a Short Assured Tenancy  is in rent arrears in Scotland, then you should use Lawpack's Section 19 Notice (AT6 Notice).
