Summary

A house share agreement (or flat share agreement) for letting a room on an Assured Shorthold Tenancy in England & Wales with a non-resident owner.

This house share agreement (also suitable for a flat share agreement) is available as a “Download Now” PDF Form.

NLA tenancy agreement logoThis tenancy agreement has been endorsed by the NLA (National Landlords Association)...so you can be confident that it is the right legal form for you.

Plus the tenancy agreement has been approved by PainSmith solicitors, leading experts in Landlord and Tenant Law...so you can be sure that it's legally binding and up to date.

If you are a landlord you can use this legal form to give to your tenant(s) at the start of their tenancy so that you have a written record of the tenant's obligations, how the tenant’s deposit money is to be handled and how the tenant’s agreement can be ended.

For this legal form the tenant must be living in a room in a property where you, as landlord, are not resident.

Under this agreement, the tenant has exclusive occupation of his/her designated room and will share the use and facilities of the house or flat (e.g. bathroom, toilet, kitchen and sitting room) with other occupiers of the furnished property.

This legal form also complies with the new law on Tenancy Deposit Protection Schemes, which was introduced on 6 April 2007.

When you download this legal form, there is also guidance provided on how to fill the house share (or flat share) agreement form in, and when to use it.

Tenancy Agreement Legal Note:
If the total amount of rent exceeds £25,000 per annum, an Assured Shorthold Tenancy Agreement cannot be created and this tenancy agreement legal form is not appropriate. If you wish to create a tenancy agreement whose rent will exceed £25,000 per annum, you can use our Contractual Tenancy Agreement (Non-Assured Shorthold Tenancy Agreement).
