Form N325 is one of several legal forms that must be used by landlords when they are evicting tenants through the courts. 

Landlords can use this tenant eviction form when they have won possession of the property through the courts, but the tenant is refusing to move out. Form N325 asks the County Court Bailiff to evict the tenant for you.

You can only use this tenant eviction form once you have issued eviction proceedings through the courts, using the N5 Claim Form and Form N119 Particulars of Claim (using the ‘traditional track’ in court) or the N5B Claim Form (using the ‘accelerated track’ in court), and the court has made an order awarding you possession of the property. 

If your tenant still refuses to leave the property, then you will need to use Form N325 to ask the County Court bailiff to physically evict the tenant from the property for you.

You must send the court a fee to deal with your request. You cannot use this tenant eviction form until after the date stated in the possession order for you to get your property back. 

The bailiff will notify you of the date when they will be evicting your tenant. You must use the bailiff to remove the tenant and not physically evict the tenant yourself, as it is a criminal offence to attempt to do so.
