Claim Form N5 is one of several legal forms that must be used by landlords when they are evicting tenants through the courts. 

You can only use a N5 Claim Form when the tenant is in rent arrears, you have already served a Section 8 Notice to terminate the tenancy agreement, and you have waited for at least two weeks for the tenant to pay and the tenant still has not paid.

To start the court process of evicting tenants, you must send the N5 Claim Form to the court to state that you want to gain possession of the property and get the rent arrears paid. 

This tenant eviction form is for use with the ‘traditional track’ in the County Court and you must use it with Form N119 - Particulars of Claim for Possession.

Landlords must send the N5 Claim Form, along with Form N119 Particulars of Claim for Possession, to the County Court to start their claim for possession. 

There are various other documents that must be attached to this tenant eviction form, including a copy of the tenancy agreement, and a court fee must be paid for the court dealing with the tenant eviction form.
